1. Application
These Terms and Conditions apply to sales of works of art and other objects by Alderton & Grey Fine Art, a trading name of Colin Stevens Ltd ("Alderton & Grey", "we", "us"). A sale is not concluded merely by submitting an enquiry or offer through this website. A contract arises only when we expressly accept an offer and issue an invoice or other written confirmation of sale.
2. Descriptions and cataloguing
We take reasonable care in researching and describing works offered for sale. Statements concerning artist, maker, authorship, attribution, school, period, date, provenance, exhibition history, literature, medium and condition are based on the information and professional opinion reasonably available to us at the time.
Statements of opinion are not guarantees unless expressly stated in writing as such. Measurements are approximate. Photographs are intended to represent works as accurately as reasonably possible, but colour and appearance can vary with lighting, photography and the buyer's screen or device.
3. Condition
Works of art are often unique and may show signs of age, restoration, conservation, wear, cracking, fading or other characteristics consistent with their history. A condition report may be supplied on request where available. Unless expressly agreed otherwise in writing, the absence of reference to a particular defect does not necessarily mean that the work is free from defects.
Prospective buyers are encouraged to inspect works personally or obtain independent professional advice where appropriate before purchase.
4. Provenance
Provenance information is supplied in good faith from records, previous owners, published sources and other information reasonably available to us. Where provenance is incomplete, uncertain or dependent upon third-party information, this will be indicated where reasonably practicable.
We do not knowingly offer property where we have reasonable grounds to believe that title is defective, the property has been unlawfully removed, or its provenance has been deliberately falsified.
5. Title
We warrant that, at the time ownership passes to the buyer, we have the right to sell the work or are duly authorised to sell it on behalf of its lawful owner. Ownership does not pass to the buyer until we have received cleared payment in full.
6. Authenticity and attribution
Any attribution is made in good faith on the basis of information and expertise reasonably available at the date of sale. Where a work is expressly sold as being by a named artist rather than described with terminology such as "attributed to", "studio of", "circle of", "follower of", "school of" or "manner of", the catalogue entry will state this.
No statement relating to attribution shall be treated as an unlimited guarantee extending beyond the terms expressly stated in the invoice or written sale agreement. Nothing in these terms excludes any statutory rights which cannot lawfully be excluded.
7. Prices and offers
Where a work is marked Offers, prospective buyers are invited to submit an offer. We are not obliged to accept the highest offer, or any offer. Taxes, import duties, customs charges, artist's resale right and delivery charges will be identified where applicable.
8. Payment
Payment must be made in the currency and by the method specified on the invoice. Unless otherwise agreed, payment must be received in cleared funds before the work is released or dispatched. We may refuse payment from a third party or from an account or wallet that does not correspond with the verified buyer.
If a purchaser wishes to pay by cryptocurrency and Alderton & Grey agrees, we will send the purchaser the appropriate wallet address and transaction-specific instructions after required AML/KYC checks. Cryptocurrency must not be sent to any wallet that has not been supplied and verified by Alderton & Grey for that transaction.
9. Cancellation and consumer rights
Where the buyer is acting as a consumer and the transaction constitutes a distance contract, statutory cancellation rights may apply. Any statutory rights apply notwithstanding anything in these terms. Where a statutory right to cancel exists, the buyer should notify us promptly in writing. Certain categories of transaction may be exempt from cancellation rights under applicable law.
10. Returns
Where a buyer has a statutory right of cancellation, any return must be made in accordance with applicable consumer law. Otherwise, returns are accepted only with our prior written agreement, except where the work has been materially misdescribed or where the buyer has another legal right to reject it. The buyer must take reasonable care of the work while it remains in their possession.
11. Export and import
The buyer is responsible for ensuring compliance with applicable import laws and taxes in the destination country. Certain works may require an export licence before they can leave the United Kingdom. Where an export licence is required, shipment will not take place until the necessary authorisation has been obtained.
12. Governing law
Unless mandatory consumer law requires otherwise, these terms and any dispute arising from them are governed by the laws of England and Wales and are subject to the jurisdiction of the courts of England and Wales.
